1. Acceptance of Terms

Welcome to Soulaimane DAHBI. These Terms of Service ("Terms") form a binding agreement between you and Soulaimane DAHBI ("we", "us", "our"). By accessing our website, browsing our products, or placing an order, you confirm that you are at least 18 years old (or the age of majority in your state) and that you accept these Terms, together with our Shipping & Returns Policy and Privacy Policy.

If you do not agree with any part of these Terms, please do not use our website or place an order.

2. About Our Store

Soulaimane DAHBI is an online home & garden retailer based at 401 Whittemore St, Whittemore, MI 48770, United States. We sell planters & pots, garden tools, outdoor furniture, garden lighting, seeds & grow kits, and home decor to customers across all 50 US states. Our tagline — "Nature Belongs Inside Too." — reflects what we curate: products that bring the garden closer to home.

We are a small, personal operation: orders are confirmed one-on-one, and you will always communicate with a real person.

3. Ordering Process

Our ordering process is deliberately personal and works a little differently from a typical checkout:

• You submit an order request through our website or by messaging us on WhatsApp;
• Our team confirms availability, shipping details, and the final total with you directly;
• We then send you a secure payment link from our payment provider;
• Your order is not final until your payment is confirmed.

Until payment is completed, you may modify or cancel your order request at any time without charge. An order request is an offer to purchase, not a completed contract — we reserve the right to decline or cancel orders, for example in cases of suspected fraud, pricing errors, or stock unavailability (with a full refund of any payment taken).

4. Pricing & Availability

All prices are listed in US Dollars (USD) and may change without notice. We work hard to keep product descriptions, images, stock status, and pricing accurate, but errors can occur. If we discover an error that affects your order, we will:

• Contact you before processing to confirm the corrected price or availability; or
• Cancel the affected item(s) and issue a full refund for any amount already paid.

Promotional prices and sale badges apply only while displayed and while stock lasts. Applicable sales tax and shipping charges are calculated and confirmed with you before payment.

5. Payment

Payment is collected through a secure payment link sent to you after order confirmation. All transactions are processed by our PCI-compliant payment provider over an encrypted connection; we never see or store your full card details.

You agree to provide accurate, current, and complete billing and shipping information, and to pay all charges associated with your order. If a payment is reversed, declined after delivery, or subject to a chargeback that is not resolved in good faith, we reserve the right to recover the goods or the outstanding amount.

6. Shipping & Delivery

Shipping times, rates, carriers, and delivery terms are described in our Shipping & Returns Policy, which forms part of these Terms. In summary: standard US delivery takes 6–14 business days after processing, shipping is free on orders over $75 (otherwise a $6.95 flat rate), and express options are available.

Delivery estimates are not guarantees. Risk of loss and title for purchased products pass to you upon the carrier's delivery to the shipping address you provided. Please ensure your delivery details are accurate — we are not responsible for orders delivered to an incorrect address supplied by the customer, though we will always help you trace them.

7. Returns & Refunds

Returns and refunds are governed by our Shipping & Returns Policy, which forms part of these Terms. In summary: we offer a 30-Day Happiness Guarantee — free returns within 30 days of delivery for eligible items in original condition — plus free replacements or full refunds for items that arrive damaged or defective (photo within 7 days of delivery).

Approved refunds are issued to your original payment method within 5–10 business days after inspection of the returned item.

8. Product Use & Disclaimer

Many of our products are garden, outdoor, and growing products. You agree to:

• Follow all instructions, safety warnings, and care guides included with each product;
• Assemble furniture and structures (such as greenhouses, swings, and hammocks) exactly as directed and observe all stated weight limits;
• Sow and grow seeds in accordance with the included guidance and your local regulations — germination and harvest results naturally vary with climate, soil, and care;
• Supervise children and pets around tools, fire pits, hanging items, and small parts.

We are not liable for damage or injury resulting from misuse, improper assembly, modification, or failure to follow product instructions.

9. Intellectual Property

All content on this website — including text, product descriptions, photographs, graphics, logos, and the Soulaimane DAHBI name and branding — is the property of Soulaimane DAHBI or its licensors and is protected by US and international copyright, trademark, and other intellectual property laws.

You may not copy, reproduce, republish, scrape, or use any of our content for commercial purposes without our prior written consent. You may share links to our pages and products for personal, non-commercial purposes.

10. Limitation of Liability

To the maximum extent permitted by law:

• Our total liability for any claim arising from a product or order is limited to the purchase price of the product concerned;
• We are not liable for indirect, incidental, special, or consequential damages (including lost profits, lost plants or harvests, or property damage) arising from the use of our website or products;
• Except for the commitments made in our Shipping & Returns Policy, products and the website are provided "as is" and "as available", without warranties of any kind beyond those that cannot be excluded under applicable law.

Nothing in these Terms limits liability that cannot lawfully be limited, including liability for death or personal injury caused by negligence, or your statutory consumer rights.

11. Indemnification

You agree to indemnify and hold harmless Soulaimane DAHBI, its owner, and its team from any claims, damages, losses, and expenses (including reasonable attorney fees) arising out of your breach of these Terms, your misuse of our website or products, or your violation of any law or the rights of a third party.

12. Governing Law

These Terms and any dispute arising from them are governed by the laws of the State of Michigan, USA, without regard to its conflict-of-law principles, and, where applicable, the federal laws of the United States.

13. Dispute Resolution

We would always rather solve a problem than argue about one. If you have a concern:

• Step 1 — Talk to us first. Contact us on WhatsApp or at hello@soulaimanedahbi.com and give us the opportunity to resolve the matter informally. The vast majority of issues are settled this way, usually within days.
• Step 2 — Formal proceedings. If we cannot resolve a dispute informally within 30 days, either party may bring a claim in the state or federal courts located in or serving Michigan, and both parties consent to their exclusive jurisdiction and venue.

Either party may seek relief in small claims court for qualifying disputes. Nothing in this section prevents you from exercising non-waivable consumer rights under your state's law.

14. Changes to These Terms

We may update these Terms from time to time. The current version is always posted on this page with a revised "Last updated" date, and changes take effect when posted. For significant changes, we will make reasonable efforts to notify active customers. Your continued use of the website after an update constitutes acceptance of the revised Terms. Orders are governed by the version of the Terms in effect at the time payment was confirmed.
